Professional Q&As for "Bank Account Bad Credit"

Hello, I am looking for a good joint account to open with my family. My father and I both feel it would be a great way to create a healthy relationship between us all. We plan to use it for primarily our cell phone bill, but it sounds like there could be endless possibilities. Our major problem using a major bank is my low credit score. I am ineligible for joint accounts (and otherwise) at both Wells Fargo and Chase. Know of any suggestions?

Some people have better luck with credit unions and credit unions can have advantages over big banks, but if you're going to file bankruptcy that might not be your best option. The article https://upsolve.org/learn/credit-unions-and-bankruptcy/ explains more.

Great article! FYI, Chime (fintech) has no issue --- in fact, they name a GREAT program, "Credit Builder" to address those who are just starting out or have been caught in a "Life" event that brought about a bankruptcy.

You need to pull your credit report. It is free to pull a weekly report right now due to covid, you won't see your score but you will get the info you need. You can pull all three reports. That will let you know who all your creditors are.

Hi Crystal, Generally, a good first step is to get your https://upsolve.org/learn/get-your-free-credit-report/ from Experian, TransUnion, and Equifax. Or the account numbers?

I'm going through emails using the filter tool because some loans were taken out online.  If the creditor put money directly in your bank account ask the bank if they can retrieve the source of those deposits. Also calling back some bill collectors in my recent calls list (but stay in charge of the conversation.  Get the info you may need and politely thank them and hang up)

I’m currently unemployed. After filing for Chapter 7 Bankruptcy, would I be able to take money out from my 401k to assist with paying some of my expenses until I start working?

Although retirement assets like 401ks are completely protected by exemptions, it's generally not recommended to take out the protected funds and turn them into unprotected cash in your bank account while the bankruptcy is pending.

Hi Shaunder, the Upsolve article https://upsolve.org/learn/can-bankruptcy-take-your-401k-or-ira/ has more information on the protections during bankruptcy.

Hi Lynn, I also recommend reading https://upsolve.org/learn/bank-account-garnished/. It discusses the limits on bank garnishments.

Upsolve Community Member
I read the article on Bank account garnishment, however I’m not sure I understand it completely. It said it could garnish electronic deposits but not paper checks or cash deposits, Did I get that right?

Upsolve Community Member
Hm, it might be a bit more complicated than that- try reading that article again and this one might help too: https://upsolve.org/learn/stop-wage-garnishment/

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
