I got a car from a tote the note place and they went out of business and never told me and kept accepting my car payment and they kept giving me temp tags for a year after I got the car. I had found out from getting pulled over that they where giving me dealers tags which is apparently illegal. I finally contacted the TxDMV because every time I asked about my permanent tags I would get the run around. The dmv investigated my claim and found out that the company has been out of business for some time now along with then surrendering their license and that they had never even filled my paperwork for my tags. I was then advised to start the process in obtaining my tags myself. Once I finished the process and received my tags and bonded title about 3 months after they came and stole my car. Please tell me this is illegal and I have rights? I have the title!

I'm not that familiar with community property laws, but there's an Upsolve article https://upsolve.org/learn/file-bankruptcy-without-spouse/ that lists some pros and cons of spouses filing together or separately in community property states and the article has information about some of the bankruptcy forms. It might have some useful information for you.

Here's an article that can help answer that question! https://upsolve.org/learn/responsible-spouse-debt/

There's a few different factors- so a first step would be reading through and asking yourself some of the questions in there (such as "What type of debt is considered?" or "Was I an authorized user?") and then ask again here if you have any other questions!

Thank you. That last article seemed to say that my spouses debt is my debt, and it seems it would be cause a phantom discharge on her debts that she acquired during our marriage.  So the next question would be do i need to list her as a codebtor on all of my accounts and I a codebtor on all of her accounts.

Will bankruptcy erase my overdue property, school and water taxes in Texas ?

Whether tax debt is dischargeable depends on the individual circumstances. Factors like when the debt was incurred, what specific type of tax debt it is, and other factors determine dischargeability.

Generally speaking, whether a debt is dischargeable doesn't depend on the state- federal rules regulate dischargeability. You can find more info in that article!

Conrgrats Olakune! Can you please share with us how long the process took? Also, by not hiring an attorney and going this way, during the whole process, does that stop the creditors from calling or filing judgements?

Hi Saed H, It's up to you if you wanna use a lawyer or not but in my experience during my research I figured out that using a lawyer will not make any difference except paying thousands of dollars that I can't afford. Remember you're trying to get rid of debts so you don't wanna end up paying someone money you can't afford. Your creditors will stop calling you as soon as your file with the court. Good luck!

How many months of bank statements do you have to provide

Upsolve Community Member
Hi Sereathia D it depends on individual circumstances, in my case my trustees requested for 3 months which must cover the last transaction date on my bank statement...I already got a Charge-Off on my accounts since April 2020 so I visited one of the branches to request for Feb - March - April statements which arrived in the mail about 10 business working days later.

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
