Are there ProBono Lawyer’s to help with Chapter 7 Hardship Bankruptcy? I can’t afford anything as my car keeps breaking down on me! I can’t really pay the fee to file bankruptcy!

Hi Jill, Here's a 10-Step Guide on how to prepare for bankruptcy and get a fresh start: https://upsolve.org/learn/how-to-file-bankruptcy/ Please continue to ask any questions. We are here to help.

Jill, TWO years ago at this time, I was asking the same question to the universe. I had never heard of Upsolve. I went to my local Legal Aid Society armed with all of my financials and my Nolo Press book stressed beyond mental boundaries. I was on a mission...

Upsolve Community Member
...and guess what? The Legal Aid Society in Long Beach doesn't handle bankruptcies! I was crushed. THIS was supposed to be the way I was going to get pro bono assistance and now it was back to square one and Google. This is the day I discovered Upsolve.

...and I found that Upsolve's Learning Center was as good or BETTER than my Nolo Press book because when I GOT STARTED with the online Interview at Upsolve and had questions, I found that by entering darn near any question I had in the Learning Center's search box, my questions were answered.

Jill, if I can do this, YOU can do this and, if you need an attorney to tackle an issue or two, OK. ---- the combo of pro se (representing yourself) OR Upsolve together with an hour or two of an attorney's time at their prevailing rate (or free if you can find it!) is a great option! That is what I do with my taxes: I use TurboTax to file myself but have a CPA "on-call" if I have any tough stuff!

I had my 341 meeting this morning and I am glad it is finally over with. To begin with they started with a role call, then the trustee said he would do all parties represented by lawyers first and then pro se. The first case took about 15 minutes worth of questioning, and the second and third parties never joined the meeting. I ended up going second instead of 4th which meant I didn't have to stay on the phone as long. He asked me if I filled out the forms myself, if I paid for Upsolve to help with the paperwork, he asked if I owned any real estate, then he opened it up for my creditors to ask questions, which only one creditor was on there to ask questions regarding the condition of the truck I was letting the bank take back. Once the creditor was done asking his questions the trustee took over again but this time to tell me what a great job i have done representing myself. My meeting itself only lasted about 8 minutes. I can not thank Upsolve enough for all the questions I've had being answered, the ease of the checklist to follow, and the support from so many people I don't even know who are going through the same thing. I feel more at ease than i did on December 8th when I filed. One other thing I wanted to mention. If someone does not qualify for Upsolve, check with your local college to see if they have a law program. Sometimes they do cases for the experience while going through school. Obviously the instructors are a huge part of it, but just know that is another option. I received a call yesterday from our University that they would help me file and answer any questions that I had. The only problem with that was I filed a month ago, but they still said to call if I needed help.

I filed my paperwork yesterday and called to get my case number. I am about to get my wages garnished starting next week. I called and spoke with the lawyers office that deals with my garnishment and they said that my garnishment will stay in place until they send paperwork to the court and it is processed. Is that true? I thought when I filed it would put an automatic stop in place. I even emailed my payroll department at work and she said that she had to receive notice from the lienholder to stop the garnishment???????Is there anything I can do to speed things up with that? I already emailed payroll showing my documents from the courthouse that I filed.

You did all the right things but follow-up is key. Once the creditor knows the automatic stay is in effect they have to do what is necessary to stop the garnishment from continuing. That may involve filing things with the state court. The most important part now is to stay on top of them to make sure they do what they need to do.

It sounds like you have a strong grasp on this process, but in case this is a helpful resource- https://upsolve.org/learn/when-wage-garnishment-stop-after-file/

I got a bill from the IRS re: unpaid taxes for 2018. Since today is 2021 does this debt qualify to be discharged? I thought I read the IRS debt has to be three years old.

The article https://upsolve.org/learn/irs-debt-and-bankruptcy states "The income tax debt must be at least three years old" and has some other important details you might want to read about.

Upsolve Community Member
The debt was for 2018 taxes. I just got the IRS letter on 12/5/2021 notifying me of the taxes.

Upsolve Community Member
What I'm trying to determine are the "dates". Since these were 2018 taxes and it's now 2021 does that mean they meet the three-year-old stipulation?

Upsolve Community Member
There are so many IRS and bankruptcy regulations, I couldn't give you a definitive answer on that. 2021-2018 is 3. But, the Upsolve article mentions that lawyers also argue about the day, not only the year.  "Note that Tax Day is not always April 15. Some years, it's April 16th, 17th, or even 18th. IRS lawyers have been known to object to discharge over one or two days. So, make sure you file the petition on the correct day or else you'll have to start over." I also know that debt that's not listed in bankruptcy doesn't have a chance of getting discharged. It might be in your interest to find out the exact day that the 2018 tax debt was incurred. You could always (painfully) call the IRS and ask.  There are other concerns mentioned in the article.

Upsolve Community Member
Jacqueline is right - it's not as simple as looking at the year the taxes are owed for and the current year. There are a LOT of moving parts. What I can tell you is that the earliest a tax debt for the year 2018 will be dischargeable is in 2022.

Hi, I received my bankruptcy discharge last month - yay, thank you, Upsolve! However, I received a notice this week that a lawsuit filed against me from one of my creditors (prior to my bankruptcy filing) is undergoing a "Generic Proceed." There is a settlement conference on 1/27/22. Is there any information you could provide on what this means and how to handle this event in court? Thank you again so much for everything you do!

You may want to send a copy of your discharge order to the lawyer representing the other side in the lawsuit and the court where the case is pending. Make sure everyone is aware of your discharge.

Upsolve Community Member
Michelle, thanks so much for asking! It sounds like the lawyers may not be aware of your bankruptcy filing

Upsolve Community Member
It may be a good idea to send them a copy of the paperwork and give them a call to make sure they're aware

Thanks for weighing in! I received these comments after speaking with the lawyer whose free consultation was recommended by Upsolve. She was amazingly helpful! Since this proceeding was in violation of the bankruptcy injunction, I had to file a copy of my discharge + proof that the creditor was correctly listed on my petition. After that, I had to contact the court clerk and ask for the case to be dismissed. They canceled it the day before the hearing!

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
