Can anyone explain how it is to purchase items such as renting or owning a home, buying a car is effected once you have filed chapter 7 or 13? Did you have to get turned down a lot from buying any of these items?

I am considering bankruptcy so that I can retire. I am 73. I live with husband we are buying a house. Will I loose my house? Our debt is around $10,000. We also own an old truck for our transportation. Will we be able to keep our vehicle?

Susan, I am over 65. As a former Upsolve user discharged in 2020, I can't advise you in any way nor am I an Attorney. From my education, however, your statement, "I am buying a house" and "considering bankruptcy" is like oil and water. I don't know your financial situation, your employment, or have your credit reports in my hands, but make sure you understand ALL OPTIONS and, if you want to buy a house, pay close attention! Hi! I am aware that the trustee will ask for bank statements. I have 2 car loans currently. My sons car buying & mine is a lease. If you look at the car payments with my income it doesn’t look possible. However my son’s car his dad pays for it every month & on mine my fiancée pays 1/2 the lease payment for me & I pay the other 1/2. How can this effect a Chapter 7 case with the trustee? I should also mention my ex-husband generally just transfers me the car payment and then I pay it out of my account. Thank you!

I just was able to get discharged after filing a ch 7 that included a reaffirmation agreement for one car. Explain to the the car lender in agreement form (the 403b, i think?) exactly how you pay for the car and lease. Once you put that in you may have to wait depending on how the courts backlogs are. I had to wait about 4 months more than usual.

What are a few draw backs of filing chapter 7? Like will it affect home buying? How long after filing and being declared for bankruptcy can you work towards homeownership?
