Is it legal to just make motions. Because why are the sueing me for someone else stealing my car then. It being impounded why would I pay for an impounded car that I didn’t get impounded?

Can filing ch 7 stop repossession of my car?

Hi Terrance, In most cases, the automatic stay is in effect immediately when you file your https://upsolve.org/learn/should-i-file-for-chapter-7-bankruptcy/ The automatic stay temporarily stops https://upsolve.org/learn/car-repossession-101/ too. Because the creditor has a lien on the car title, the bankruptcy only temporarily stops the repossession. The creditor can take the car after the Chapter 7 case is closed or ask the court to take the car before the case is closed if you do not work something out with the lender.

Is there paperwork or anything I would need to rescind a reaffirmation before its filed in the court..Signed reaff paperwork on dec 14th and sent to creditor....Then sent creditor bankruptcy rep an email rescinding the reaff two days later. Is there an official form that I need to send to this rep in addition to this email I sent to make it official before creditor files....and btw this is a credit union........i am aware of the collateral consequences i have decided to surrender the vehicle along with my loan with the credit union.....

It depends on where in the process your case currently is. Has your 341 meeting happened already?

As a first step, it's generally important to call the bank and let them know of your change of plans. Then, depending on when your case was filed, you may need to file an amendment or may need to take other steps.

After my 341 meeting I received a Notice of Motion and Motion for Relief from the Automatic Stay from one of the cars I included in my bankruptcy Chapter 7. What should I do?

If you're https://upsolve.org/learn/surrender-car-bankruptcy/, there's nothing you have to do. Once the motion is granted, the bank will be able to pick up the car.
