If the time of service was after your case was filed, it's considered a https://upsolve.org/learn/post-petition-debt/. Anything from before filing will be covered, even if the invoice comes later. What's key is to collect all the relevant information (and mailing address) from your provider so you can rest assured that the bankruptcy court notices will be sent to the correct address.

Andrea's exactly right- what matters is the date the debt was incurred, not the date that you received the bill

The important thing to consider here is that debt incurred after filing isn't dischargeable in this bankruptcy. This might be helpful: https://upsolve.org/learn/how-often-can-you-file-bankruptcy/

Hi Joseph,  Here is an Upsolve article that covers this topic: https://upsolve.org/learn/do-not-remember-creditors-owed-chapter-seven-bankruptcy/ Do not hesitate to ask any further questions.

One way to find debt amounts is to get a current copy of your credit report. https://upsolve.org/learn/get-your-free-credit-report/ Please reach out with any other questions.

Other Upsolvers have also found it helpful to look at old bills! Sometimes, certain debts won't show up on your credit report, so it's usually a good idea to check wherever you can.

Hi Debra, I am sorry to hear about your mounting medical bills. Perhaps this article, from the Upsolve Learning Center, will help https://upsolve.org/learn/getting-out-of-medical-debt/ Good luck! :-)

Debra, although Mark's article directly answers your question, you might also be interested in reading https://upsolve.org/learn/type-debt-erase-chapter-7-bankruptcy/. The article does list medical debt as a type of debt that can be erased during a Chapter 7 bankruptcy.

Thanks for asking this, Debra- yes, generally speaking, medical debt is dischargeable in bankruptcy. That doesn't necessarily mean that bankruptcy is your best or only option. You can also consider other options if you choose.

So I had my 341 meeting and I haven't gotten a discharge yet , but I have one particular hospital I owe money too that will not stop trying to collect for months now thru my bankruptcy. Anyone know how to file a motion to alert the court. Ive contacted them several times and they won't stop calling emails and mailing bills

Hi Jennifer! If you are the responsible party for payment and she is the patient, yes. Here is an article from the Upsolve Learning Center: https://upsolve.org/learn/get-rid-of-medical-bills-in-bankruptcy/. I hope this helps and good luck! :-)

You might also want to read the article https://upsolve.org/learn/type-debt-erase-chapter-7-bankruptcy/. It has an informative list of the different types of debts that can be discharged in bankruptcy.

The key factor here is who is the "responsible party." Most of the time, for a person under 18, that is their parent/legal guardian. You might be able to check with the hospital or doctor's office to confirm that you are the responsible party for the debt

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
