Hi Dennis! I am Upsolve alumni and received my discharge in the summer of 2020. Everybody's financial situation is different, to be sure, but IMO, one of our objectives from a personal finance standpoint is to have a "clean" credit report.

When we emerge from Chapter 7, there will be a Public Record (Bankruptcy) on the reports, and all creditors listed in our bankruptcy will be deleted. However, LATE PAYMENTS will remain which figure into your credit score. So, IMO, the more you are able to keep payments on time until filing, the better! :-)

I want to make sure I can keep my car and one of the credit cards. The one with the lowest balance. Is this possible?

Hello Gloria, Most people can keep their car and get debt relief by filing bankruptcy. Hi Amanda! Erin pointed you to great info on this subject. After exhausting every avenue with the banks and arranging payment plans with lower monthly payments and, in some cases, lower interest rates, it STILL wasn't going to be enough to allow me any breathing room to live life, and that is when I decided to file Chapter 7. For me, I was perfect at paying on time (credit cards only) while I was trying to keep my head above water. It turns out I had one late payment with Cap 1 and I disputed that with the 3 credit bureaus. My reasoning was to have clean credit reports other than the Public Record of Chapter 7 bankruptcy. To answer your question, I filed on a day where the majority of my credit balances were coming due in the billing cycle. This isn't advice, but it is telling you my experience that perhaps will help you. :-)

Keep in mind you'll need to take a credit counseling course before you file. I recommend reviewing Upsolve's guide https://upsolve.org/learn/how-to-file-bankruptcy/ to get a better idea of the timeline.

Hi Tarshi! OK, if you aren't asking why Upsolve was developed to assist those who cannot afford attorney (which was to give ALL PEOPLE an equal opportunity to file bankruptcy) then you are asking why we file, right? Well, I filed because an unfortunate event hit our family and my credit cards eventually got maxed out. I had paid on time but, eventually, my income wasn't enough to keep up with the bills. How about you? :-)
