If you need to file a Subchapter V bankruptcy you should do so with the assistance of an experienced attorney. It's not designed for consumers and not straightforward like a simple Chapter 7.

Filed Chapter 7 11/2014, discharged 3/2015. We are currently homeless due to COVID since 7/2021, husband is in SSI application process, I work full-time, but have medical issues that result in me losing time, husband's clutch went in car and I had to get a car note to get to work. I don't want to lose my car or our storage unit. Can I fe chapter 7 again or is 13 better

Filed Chapter 13 on September 17, 2021 341 Meeting on 11/4/2021 Discharged today 1/7/2022 100% easy process and throughout the journey never had a deficiency (missing item or entry on the forms) during the filing, was complimented by Trustee as many attorney's have deficeienies and file for clients for a living! Kudos to the Upsolve Team and the community for the help. You guys ROCK!

I was discharged in June of 2020 and it has been an interesting rebuilding process! :-)

@rahmel- mine 341 was over the phone.  @Michael I filed on 9/17 and didn't have the 341 until 11/4 then 60 days for creditors to object.

Hello, I owe tuition money to a university for a Pell Grant that was returned due to my not completing the semester. Should I include this and if yes, where do I include it? Currently I have it listed under student loans which is not totally accurate. Does it need to be included at all? It's not listed on my credit report.

My opinion only: Include it. It won't hurt. If there is a problem, you will be alerted and you can always edit or amend later. This is all better than not reporting something and losing sleep over it. :-). Good luck ahead! :-)

The instructions for the bankruptcy form for unsecured debts (Schedule E/F) states "When you file for bankruptcy, the court needs to know who all your creditors are and what types of claims they have against you." The Upsolve article https://upsolve.org/learn/chapter-7-bankruptcy-forms-explained/ has information and links to bankruptcy forms. Also, 11 U.S. Code § 521 on debtor's duties states that the "debtor shall file a list of creditors." There have been Pell grants listed in bankruptcy before. The Upsolve short learning center article https://upsolve.org/learn/need-list-all-creditors/ says "You should do your best to list all of the companies you owe money to on your bankruptcy forms." I'm just spouting out facts I read but I hope it helps!
