It's common to feel worried about how bankruptcy might impact your ability to get a new job, but it's not common to be denied a job due to bankruptcy

Can I file bankruptcy chapter 7 online if I don't use an attorney? The court where I have to file is not close to me, and I don't have a car or money to get there.

Here is a helpful Upsolve article on the topic of filing online: https://upsolve.org/learn/can-i-file-bankruptcy-online/

Your court may (or may not) have online filing and filing by mail options. You can search their website to see if that option is available to you!

Hi Cleo, Upsolve really makes the process of filing bankruptcy easier. If you decide to file online directly with a court, I highly recommend you review the https://upsolve.org/learn/pacer-guide/. It will help you become familiar with the electronic filing system. Some courts only allowed online filing with the Covid pandemic. With the new surge, some courts might again offer the opportunity to file online. The article https://upsolve.org/learn/courts-covid/ has some useful information about the online bankruptcy filing process.

My biggest debt is my student loans. I dont make enough money to keep up on my bills and be able to eat if i have to make payments. I would end up losing everything and become homeless. What can i do? I know people have been able to file and win if they can prove economic hardship. Just scared and nervous about doing it and my husband thinks its a bad idea. Not sure what i should do.

Hi Starr, so glad you're here! For student loans, there is absolutely no reason why you can't be in an income-based repayment program regardless of whether you file bankruptcy. Check out https://upsolve.org/learn/4-income-based-repayment-options-for-federal-student-loans/ in our Learning Center to find out more!

Greetings Starr! Andrea W. is spot on. Millions are there having this problem.  I have been researching student loan debt and have developed a FREE online  "workshop" that covers the basics in making sure you have the optimum student loan for YOUR situation. The workshop is for people with Fed loans (the micro-course does not cover Private loans) and, in a nutshell, is a public service announcement for the Department of Education since it is the SIMULATOR you will find there that can be the first and best source of finding out what your monthly payment would be under the IDR program (as mentioned in Andrea's comment) options available to you. If you want to learn more about the Simulator, click on my profile pic and it will take you to a link where you can register for the free workshop. I also am keeping up with the almost daily movement on Capitol Hill concerning this crisis. Starr, let me know if you are on an IDR plan. Good luck! :-)

Thanks so much for asking- lots of people come here to ask about student loans- really glad you're here and looking forward to seeing your other questions.

Have you shared the article on https://upsolve.org/learn/pros-cons-filing-chapter-7-bankruptcy with your husband?  I don't know if he's open to learning more, but maybe discussing each pro and con separately could help the decision-making process.

Hi Jill, Here's a 10-Step Guide on how to prepare for bankruptcy and get a fresh start: https://upsolve.org/learn/how-to-file-bankruptcy/ Please continue to ask any questions. We are here to help.

Jill, TWO years ago at this time, I was asking the same question to the universe. I had never heard of Upsolve. I went to my local Legal Aid Society armed with all of my financials and my Nolo Press book stressed beyond mental boundaries. I was on a mission...

Upsolve Community Member
...and guess what? The Legal Aid Society in Long Beach doesn't handle bankruptcies! I was crushed. THIS was supposed to be the way I was going to get pro bono assistance and now it was back to square one and Google. This is the day I discovered Upsolve.

Upsolve Community Member
...and I found that Upsolve's Learning Center was as good or BETTER than my Nolo Press book because when I GOT STARTED with the online Interview at Upsolve and had questions, I found that by entering darn near any question I had in the Learning Center's search box, my questions were answered.

Jill, if I can do this, YOU can do this and, if you need an attorney to tackle an issue or two, OK. ---- the combo of pro se (representing yourself) OR Upsolve together with an hour or two of an attorney's time at their prevailing rate (or free if you can find it!) is a great option! That is what I do with my taxes: I use TurboTax to file myself but have a CPA "on-call" if I have any tough stuff!

Upsolve Community Member
Conrgrats Olakune! Can you please share with us how long the process took? Also, by not hiring an attorney and going this way, during the whole process, does that stop the creditors from calling or filing judgements?

Hi Saed H, It's up to you if you wanna use a lawyer or not but in my experience during my research I figured out that using a lawyer will not make any difference except paying thousands of dollars that I can't afford. Remember you're trying to get rid of debts so you don't wanna end up paying someone money you can't afford. Your creditors will stop calling you as soon as your file with the court. Good luck!

How many months of bank statements do you have to provide

Upsolve Community Member
Hi Sereathia D it depends on individual circumstances, in my case my trustees requested for 3 months which must cover the last transaction date on my bank statement...I already got a Charge-Off on my accounts since April 2020 so I visited one of the branches to request for Feb - March - April statements which arrived in the mail about 10 business working days later.

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
