Hi. Did you do it all yourself or hired a lawyer. Thinking about filing chapter 7 and not sure if I should hire a lawyer or do it myself

Conrgrats Olakune! Can you please share with us how long the process took? Also, by not hiring an attorney and going this way, during the whole process, does that stop the creditors from calling or filing judgements?

Hi Saed H, It's up to you if you wanna use a lawyer or not but in my experience during my research I figured out that using a lawyer will not make any difference except paying thousands of dollars that I can't afford. Remember you're trying to get rid of debts so you don't wanna end up paying someone money you can't afford. Your creditors will stop calling you as soon as your file with the court. Good luck!

How many months of bank statements do you have to provide

Hi Sereathia D it depends on individual circumstances, in my case my trustees requested for 3 months which must cover the last transaction date on my bank statement...I already got a Charge-Off on my accounts since April 2020 so I visited one of the branches to request for Feb - March - April statements which arrived in the mail about 10 business working days later.

Barbara, I'm thinking of asking Upsolve to open a "Deep Breathing" Room because there are many fellow Upsolvers who have been financially stressed out for quite some time now. Ugh! But relief is on the way. Start envisioning your life a few months from now without that giant weight on your back. It's a good feeling, this FRESH START! Thank you all for the encouragement. I’m going to work on completing my bankruptcy package this weekend so I can get it mailed out on Monday. I think a deep breathing room is a wonderful idea. I’m looking forward to relieving the stress & anxiety I feel with my debt issues.

I was discharged in July of 2020 after filing Chapter 7 using the Upsolve platform and Learning Center. I am an educator and have been researching the student loan debt crisis for the last year. Student loan debt is so complicated, your help is certainly needed and appreciated! I'm excited about the New York legislation that will help release transcripts to people with student debt. https://upsolve.org/learn/getting-school-transcripts/ is a struggle when you owe student debt!

The DOE is meeting this week and I've been able to sit in on some industry sessions. This is why you might have heard Schumer, Warren, and the usual folks repeat their call for $50K forgiveness. I have my opinions, thoughts, and intel but I'll save it since crystal balls can be worthless. HOWEVER, there are some measures being talked about that would benefit lower income undegrads so that's a plus! Stay tuned! :-)

Im 24 years old, have came into quite a bit of debt. Partially due to the obvious young age and making poor choices (I.E. lifestyle inflation etc.), along with switching roles at my job for less pay. The reason for that was a quality of life imporvment. No more long nights, massive amounts of OT, constant stress and so on. Would filing for this make my life harder? Or with my young age would it make it eaiser than paying back the 25k+ in debt? Anxious on making the life choice here.

One of the things to consider is whether you could repay your current unsecured debt in 5 years if nothing at all changes about your income, the balances, or the interest rates. Of course, timing plays a role here too. It's not ok to run up more CC debt than one can handle and then turn around to file bankruptcy. But that's not the same thing as dealing with a mistake from your past by seeking protection in bankruptcy court now.

Devyn, I commend you for being REAL! The first step is acknowledging that some poor choices were made along the way. Very few would admit that, yet we ALL have made some poor choices during our life journey. I am reading GREAT NEWS in your post because you KNOW who it is up to learn new habits, such as setting up a budget and STICKING TO IT.  Since I filed Chapter 7 in 2020, I have "raised" $30,000 by pivoting and working side gigs. Sure, I was the beneficiary of the Stimulus payments, but that same $25K (the debt you say you have) was "raised" in less than a couple of years' time. We are all different animals in how we live life, but I will give you a personal opinion based on your intelligent post that you can pay that off. That's just my opinion! Same. I was so happy when I told my mom. She said her generation (baby boomer) was ashamed to file but mine (millennial) wasn’t. Lol

Because it's a moment in time and while it feels like a huge failure at the moment (understandably so) soon you will realize that doing this and taking your life back in your own hands is the only responsible thing you can do.

I'm 7 years post bankruptcy and just now identifying that embarrassment or even shame may be behind my low level depression.  I came across this site in my search around this issue.  I'm hoping that my naming it and doing some uncovering may now lead to releasing it.   Its complicated - with regret, and an ongoing sense of what I've lost ( not having a home mostly) and the very real significant lifestyle changes this had led to.  And a real sense of unfairness ( which is hard to admit to as I  feel I 'should' be more accepting and positive about what I  do have).
