I was discharged in July of 2020 after filing Chapter 7 using the Upsolve platform and Learning Center. I am an educator and have been researching the student loan debt crisis for the last year. If you have questions about navigating student loan repayment plans and current legislation on relief options, I will be able to help you find your answers. :-)

Student loan debt is so complicated, your help is certainly needed and appreciated! I'm excited about the New York legislation that will help release transcripts to people with student debt. https://upsolve.org/learn/getting-school-transcripts/ is a struggle when you owe student debt!

The DOE is meeting this week and I've been able to sit in on some industry sessions. This is why you might have heard Schumer, Warren, and the usual folks repeat their call for $50K forgiveness. I have my opinions, thoughts, and intel but I'll save it since crystal balls can be worthless. HOWEVER, there are some measures being talked about that would benefit lower income undegrads so that's a plus! Stay tuned! :-)

Can I file bankruptcy chapter 7 online if I don't use an attorney? The court where I have to file is not close to me, and I don't have a car or money to get there.

Your court may (or may not) have online filing and filing by mail options. You can search their website to see if that option is available to you!

Hi Cleo, Upsolve really makes the process of filing bankruptcy easier. If you decide to file online directly with a court, I highly recommend you review the https://upsolve.org/learn/pacer-guide/. It will help you become familiar with the electronic filing system. Some courts only allowed online filing with the Covid pandemic. With the new surge, some courts might again offer the opportunity to file online. The article https://upsolve.org/learn/courts-covid/ has some useful information about the online bankruptcy filing process.

So I’m really nervous about filling for bankruptcy I’m in so much debt, way over my head and do not want to file without opinions from the community, I have no car, or house in my name. I own nothing but will be starting a new job in a couple weeks, can anyone let me know if starting a new job will effect this process, how the process went for you and if you had to attend any court hearings?

Hi Greg! First of all, congratulations on finding a job!!!! Next, I will offer my opinion because you asked. Everyone's situation is different so I can only speak for myself. When I filed bankruptcy using Upsolve, I had recently been successful in finding an apartment so I was no longer homeless, but I had no car. I took the bus....

....At the time, I was 65 years old and had lost almost everything in a family tragedy that could happen to anyone. It happened to me. Today, I contribute to Upsolve because I know it can help others. I don't ever want anyone to go through what I did and I know how stressful it is when contemplating filing bankruptcy. Greg, get familiarized with https://upsolve.org/how-we-work/ ...

You will have one meeting called a 341 Meeting, it is a short meeting. https://upsolve.org/learn/mock-341-meeting/

You will still need to pass the Means Test with your new job: To understand about this more, you can see this article: https://upsolve.org/learn/chapter-7-means-test-calculator/

This was so easy. Starting anew job will not effect you. You can also file papers to have the filing fee waived due to your income. Due to covid my court hearing was a 10 minute phone call. Don't be nervous Upsolve is an easy step by step process

Hi Patrice, thanks so much for your question! Generally speaking, debt collectors are not allowed to sue someone for the debt discharged in bankruptcy. Our team created an article that might help you learn more! You can read it here: https://upsolve.org/learn/debt-collection-after-discharge/

Even if you don't have your discharge yet, the automatic stay will prevent creditors from filing a new lawsuit. This article has more: https://upsolve.org/learn/the-automatic-stay/

Once bankruptcy is filed there is an automatic stay that prevents creditor from trying to collect / harass you

I have a chase cc account that is included in my bankruptcy filing. I also have a Chase checking account; can Chase take funds from my checking to cover my cc debt? Do they have to inform me? Should I move my savings account to another bank?

Typically whatever is dismissed in the BK that's it, they cant come after you any more.I have seen that Chase will close your account. I would advise opening up a new account elsewhere.

Upsolve Community Member
they closed my cc account? are you saying they can close my checking account as well? What about my funds

Upsolve Community Member
My 341 meeting is scheduled for 10/8/21.

Hi Mark! In general, once a case is filed the automatic stay prevents the bank from taking funds out of your account. This article might provide some more useful information: https://upsolve.org/learn/keeping-a-checking-account-during-bankruptcy/

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
