When I submit my packet to the court how soon will my vehicle be removed from my possession? Do I turn it in our do they come and get it.

I tried to turn mine in too.  They'll just ignore you and come get it very early one morning or in the middle of the night.  just clear out all of you belongings or they will be lost.

Hello! When mine was done I worked with the creditor for a convienant time. Technically from the date you file your bankruptcy they cannot reposses for 60 days unless you sign a waiver of that right for that specific car.

I got a car from a tote the note place and they went out of business and never told me and kept accepting my car payment and they kept giving me temp tags for a year after I got the car. I had found out from getting pulled over that they where giving me dealers tags which is apparently illegal. I finally contacted the TxDMV because every time I asked about my permanent tags I would get the run around. The dmv investigated my claim and found out that the company has been out of business for some time now along with then surrendering their license and that they had never even filled my paperwork for my tags. I was then advised to start the process in obtaining my tags myself. Once I finished the process and received my tags and bonded title about 3 months after they came and stole my car. Please tell me this is illegal and I have rights? I have the title!

Hello, my work truck was repossessed last year due to losing my business cause of Covid. Lender wouldn’t work with me so we let them repossess it. Now I’m being sued for remaining balance owed. We were planning on filing chap 7 due to Covid lockdowns destroying our finances but still have to wait another year as we previously filed in 2015. My question is if this results in a judgement against me (bank levy etc) can it be discharged with a chap 7 filing??

were you a sole proprietor (1099) type worker OR was your business incorporated under a LLC or INC?  if it was an LLC or INC, you are potentially not personally liable for the debt and you can put your LLC or INC through a bankruptcy but to go that route since it would be a non-personal bankruptcy you'd have to have a lawyer involved in the bankruptcy for an LLC or INC.

Filing a Chapter 7 bankruptcy can temporarily delay a repo - if it's filed before the car is picked up - but it doesn't provide any mechanism to catch up on payments.

Hello! I want to file for Chapter 7. I had a car repoed because I owed way more than it was worth and didn't want to continue the payments - dealership was very pushy. I ended up using my savings to purchase a very old used car and also borrowed money from my mom. I am currently paying my mom back on that car. I also have another car in my name that my boyfriend pays - we have 3 kids so need 2 cars for work and school. Would I be able to keep both cars or would they reject my filing if I had a car repoed and then bought another?
