Willa, thanks for asking! Before filing, the process is in your control. It's up to you when you decide is the best time to file- and whether you'd like to file with Upsolve, an attorney, or independently. After filing, the process takes about 4-6 months, depending on the circumstances.

A Chapter 13 bankruptcy will take much longer, 3-5 years. If you're exploring your options, the Upsolve article https://upsolve.org/learn/how-long-does-chapter-13-bankruptcy-take/ might be helpful.

That's a good question!

Before filing, when to file and how long it takes is generally up to you. As an Upsolve user, the sooner you complete the questionnaire, the sooner the generated forms will be available, generally speaking.

Once you file, the process takes between 4-6 months. You can learn more here! https://upsolve.org/learn/chapter-7-bankruptcy-timeline/

Thanks for asking! For the Upsolve questionnaire, it's up to you! It's designed to take about a week to complete the questionnaire and about 2 weeks for the form generation process, but it depends on how long you need. After filing, the process takes about 4-6 months for most "no asset" cases

It will depend on your unique circumstances, the particular court, and the schedules of the judges and trustees. Generally, a simple Chapter 7 could be finished in 4-6 months. A Chapter 13 could take 3-5 years. This Upsolve article has more information: https://upsolve.org/learn/how-long-does-chapter-7-take/.

That's all after you get the paperwork ready- when you're working on the Upsolve questionnaire, you're in control of how long it takes. If you're in a rush to file, the sooner you complete the questionnaire generally means the sooner the forms will be ready!

It's generally designed to take a week, but how long each person takes depends on their circumstances and it's up to you.

I’m filing my bankruptcy tomorrow through the mail. How long does it normally take to go through the whole process? Also my job has received paperwork to have my wages garnished for a car that was repossessed. How soon after filing will this garnishment stop?

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
