There's no minimum amount of debt required, but Chapter 7 bankruptcy might not be a good fit for everyone. There's certain costs to filing for bankruptcy (like the filing fee) and other options (like payment plans) might be a good option for some people. You can learn more here! https://upsolve.org/learn/how-much-debt-do-i-need-to-file/

So I’m really nervous about filling for bankruptcy I’m in so much debt, way over my head and do not want to file without opinions from the community, I have no car, or house in my name. I own nothing but will be starting a new job in a couple weeks, can anyone let me know if starting a new job will effect this process, how the process went for you and if you had to attend any court hearings?

Hi Greg! First of all, congratulations on finding a job!!!! Next, I will offer my opinion because you asked. Everyone's situation is different so I can only speak for myself. When I filed bankruptcy using Upsolve, I had recently been successful in finding an apartment so I was no longer homeless, but I had no car. I took the bus....

....At the time, I was 65 years old and had lost almost everything in a family tragedy that could happen to anyone. It happened to me. Today, I contribute to Upsolve because I know it can help others. I don't ever want anyone to go through what I did and I know how stressful it is when contemplating filing bankruptcy. You will still need to pass the Means Test with your new job: To understand about this more, you can see this article: https://upsolve.org/learn/chapter-7-means-test-calculator/

This was so easy. Starting anew job will not effect you. You can also file papers to have the filing fee waived due to your income. Due to covid my court hearing was a 10 minute phone call. Don't be nervous Upsolve is an easy step by step process

Hi David, thank you so much for your question! This article might be of some help: https://upsolve.org/learn/irs-debt-and-bankruptcy/

Upsolve Community Member
Thank you. Seems like inorder to discharge irs debt I would have to wait to file chapter 7 till the 3rd year from my irs notice?

Upsolve Community Member
David - answering that question involves a legal analysis that unfortunately only a lawyer can provide. If you think you're close to being able to discharge your IRS debt, it may be a good idea to talk to a BK attorney about it... filing even just a few days too early can make a difference on this...

Hi Gloria, Most people can keep their car and get debt relief by filing bankruptcy. Here is an Upsolve Article that covers this topic: https://upsolve.org/learn/can-keep-car-file-bankruptcy/

Sometimes, in this situation, redemption is a good option! Redemption is, generally speaking, where you pay for the car's current value in a single payment, no matter how much you owe.

It's your choice and depends on your circumstances- let us know if you have more questions about keeping a vehicle!

I am considering filing for bankruptcy. I am so stressed. I am worried about keeping my car, it is my way to get to and from work. I still make payments on it, my boyfriend is a cosigner. Will I lose my car? I have no other assets. I am drowning in payday loans. Are these included in bankruptcy?

Hi Kimberly! You asked some great questions! Dealing with debt and the bankruptcy process can be stressful, but ironically the stress will reduce stress in the future—for a much longer time than the bankruptcy process takes. Now let's look at your concerns. First, the car.  It will depend on your car, your payment history, your creditor's policies, and your debt. The article https://upsolve.org/learn/can-keep-car-file-bankruptcy/ explains more. Many people keep their car during bankruptcy.  There is also a helpful article https://upsolve.org/learn/what-happens-to-the-co-signer-of-a-car-in-bankruptcy/ that explains the consigning situation. The article https://upsolve.org/learn/can-bankruptcy-help-with-payday-loans/ can answer your payday loan question. Hang in there! You got this! Ask us any questions through the process and we'll do our best to help!

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
