Chapter 7 may not help you stop a foreclosure. The fact that the house is not in your name is also hugely significant. Your best bet for saving your family home from a https://upsolve.org/learn/tax-foreclosure/ is likely talking to a lawyer that knows property tax lien issues in your state.

Hello Upsolvers! I’m one of the User Advocates here at Upsolve. I wanted to pass along a resource which you might find helpful :) There’s a new https://www.getctc.org/en (from The White House and Code for America) that helps families claim their Child Tax Credit benefits. This is a great place to check if you and your family may qualify and file the forms needed to receive payment!

I had the same question in 2020 and this is the article I learned from at that time. It has since been updated Nov 2021: https://upsolve.org/learn/tax-refund-in-bankruptcy/ Good luck! :-)

Great question- did that article help?

I am married but I do not live with my husband, why do they ask for his income? Also we have one joint credit card I do not want to include it in the bankruptcy, is that possible?

Hello Ismaray, If you are filing a Chapter 7 bankruptcy, and both you and your spouse file your taxes together, then you will need to include your spouse’s income and expenses on your bankruptcy forms. Here is an Upsolve article to give you some guidance on this topic: https://upsolve.org/learn/including-spouses-income-and-expenses/

Ismaray,  Even though you may want to leave certain debts out of your bankruptcy filing, you're not permitted to actually do so. Here is an Upsolve article on this topic: https://upsolve.org/learn/can-i-leave-debts-out-of-my-bankruptcy/ Do not hesitate to ask additional questions. We are here to help you.

Are you also an owner to the credit card, or are you an authorized user? Depending on the answer, the debt may or may not be required in your bankruptcy filing. I am previewing the Voluntary Petition draft. Why on the second page does it mention business names I've had in the last 8 years, when Upsolve's form only asked for the last 4 years? (I do have a business I've had in the last 8 years, but not the last 4)

Michelle, thanks so much for asking! I took a look but it does look like the software asks for the past 8 years. If you need to update your answers, feel free to re-do the "About You" section.

If you'd like assistance, I'm also happy to enter the information- just reply here with the names you need added and I can update your account.

Thank you! I looked back at my tax information and I won't need to include that business (it was in my name and my own social security as TIN anyway). However I'm not sure if what's currently on the draft (A Place for Rover) needs to be there. I did a lot of work as Independent Contractor / Gig and the draft doesn't list any of those even though I listed them in the business section. A Place for Rover is Independent Contractor work (somebody else's business that I am not an employee of, but do work through as a self business). Do you have maybe an idea about that?

Upsolve Community Member
And thanks Claire you are really super helpful, throughout this process

Upsolve Community Member
Yes I think after checking everything over that A Place for Rover should not be listed as a Business Name, as it is a Sole Proprietorship. I would need help taking that off (as I don't know how it got on!)

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
