Generally speaking, unemployment overpayment is dischargeable in bankruptcy.

Great question! Keep on asking

Be sure to check your unemployment records and receipts! The Unemployment office has been overwhelmed and it's possible errors in accounting or dates were made. You might also be interested in this article: https://upsolve.org/learn/will-bankruptcy-stop-wage-garnishment/

Veronica, thanks so much for reaching out! This isn't something that Upsolve's software helps with directly- but you've come to a good place to ask questions and learn more!

It sounds like you're hoping to contest the overpayment and file an appeal. Is that right?

Is it totally normal not to hear anything from a trustee before a 341 meeting? I emailed my tax form and a statement about lack of income due to unemployment since 2019 and although the trustee’s website states that email is her preferred method of contact, I have not heard anything. I recently sent the same information via certified mail just in case. A phone message I left was never returned and my 341 meeting is in two weeks. Should I be concerned? Isn’t she supposed to mail me something (a document I have already read online)? Am I worried for no reason?

Unfortunately, that's normal Stephanie. A lot of trustees don't have the bandwidth to communicate individually with filers before the 341 meeting (though most still send at least some kind of letter... )

I got a voicemail message from her. Someone else sent the document I am supposed to read before the meeting.

Almost exactly 2 years ago, I sold a car to Carvana because I could no longer afford the payment. I paid off the loan and then had about $5k left over. I was unemployed, so I used that money to help with food/rent for a year (after unemployment ended.) . Then I bought a cheap vehicle with the remaining 3K. Does this count as transferring valuable property in the past two years to someone outside the normal course of my financial affairs? Thank you

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
