Hi. Did you do it all yourself or hired a lawyer. Thinking about filing chapter 7 and not sure if I should hire a lawyer or do it myself

Conrgrats Olakune! Can you please share with us how long the process took? Also, by not hiring an attorney and going this way, during the whole process, does that stop the creditors from calling or filing judgements?

Hi Saed H, It's up to you if you wanna use a lawyer or not but in my experience during my research I figured out that using a lawyer will not make any difference except paying thousands of dollars that I can't afford. Remember you're trying to get rid of debts so you don't wanna end up paying someone money you can't afford. Your creditors will stop calling you as soon as your file with the court. Good luck!

How many months of bank statements do you have to provide

Hi Sereathia D it depends on individual circumstances, in my case my trustees requested for 3 months which must cover the last transaction date on my bank statement...I already got a Charge-Off on my accounts since April 2020 so I visited one of the branches to request for Feb - March - April statements which arrived in the mail about 10 business working days later.

Barbara, I'm thinking of asking Upsolve to open a "Deep Breathing" Room because there are many fellow Upsolvers who have been financially stressed out for quite some time now. Ugh! But relief is on the way. Start envisioning your life a few months from now without that giant weight on your back. It's a good feeling, this FRESH START! Until then, as Andrea says, deep breaths -- 3 of them!                            Good luck! :-)

Thank you all for the encouragement. I’m going to work on completing my bankruptcy package this weekend so I can get it mailed out on Monday. I think a deep breathing room is a wonderful idea. I’m looking forward to relieving the stress & anxiety I feel with my debt issues.

I filed my paperwork today at the court house. I had worked my anxiety through the roof. I was so nervous doing this myself. The clerk was soo nice and helpful. He made sure I had everything in order. I had WAY more paperwork than I needed.. but that’s ok. lol... I could not have done this without Upsolve and the team helping me along the way. Ready to take my next class and prepare for my 341 meeting. Thank you Upsolve!!

I just had my 341 Meeting and I can confirm it is so much easier than we all anticipate! I have spent the last month stressing about it and barely slept last night but as everyone says, it’s a breeze and mostly yes or no answers. I want to share my experience as I know reading other people's posts was a great help to me. My meeting was scheduled for 10AM and I joined the call about 10 mins early and heard the end of the case before me. My meeting started at exactly 10AM. The trustee first asked me if I had sent her all the required documents, which I confirmed I had and I did remind her she had replied to confirm she had received them. She had to look through her email to find them which made me feel like she hadn’t reviewed them in advance. Once she found them we started the meeting. I had to confirm my name for the record and then it was honestly mostly the same yes or no questions that were mentioned in the Upsolve 341 Meeting. Have I filed BK before; marital status; do I owe alimony or child support; am I renting; have I seen an attorney in the last 3 years; any issues with medical devices, confirm place of employment, have I read the bankruptcy information sheet, did I sign and read my petitions etc. As I do not own a car, she did ask how I get around now. I told her I use my BF's car and she asked if I have ever owned a car before which was no for me. She asked if my BF who I listed as a dependent received any benefits or had income, which I explained no and why. She asked if he was seeking employment and I explained the situation. She asked why I filed for bankruptcy which I explained and she needed no further information. She reminded me to file my second BK course certificate which I told her I already have. She said there is nothing more I need to do and this concludes the meeting and I can hang up. The meeting was over in 5 mins! Now it’s just a waiting game for 60 days and I am hoping everything goes through smoothly. Thank you so much to Upsolve and the Community as you have been such a help. This platform is really a wonderful tool and blessing. Good luck to everyone else going through this process!

This pretty much mirrors every 341 Meeting I've read accounts of yet your story is important because this Community is filled with stressed, scared, apprehensive folks in a pandemic world with lots of challenges. What we DON'T NEED at the moment is for our attempts to do something about our economic situations to go sour. This is why Upsolve fills a huge role during "all this". In my book BIGGER than even Upsolve realizes! Thanks for your story and good luck going forward! :-)

I had my 341 meeting this morning and I am glad it is finally over with. To begin with they started with a role call, then the trustee said he would do all parties represented by lawyers first and then pro se. The first case took about 15 minutes worth of questioning, and the second and third parties never joined the meeting. I ended up going second instead of 4th which meant I didn't have to stay on the phone as long. He asked me if I filled out the forms myself, if I paid for Upsolve to help with the paperwork, he asked if I owned any real estate, then he opened it up for my creditors to ask questions, which only one creditor was on there to ask questions regarding the condition of the truck I was letting the bank take back. Once the creditor was done asking his questions the trustee took over again but this time to tell me what a great job i have done representing myself. My meeting itself only lasted about 8 minutes. I can not thank Upsolve enough for all the questions I've had being answered, the ease of the checklist to follow, and the support from so many people I don't even know who are going through the same thing. I feel more at ease than i did on December 8th when I filed. One other thing I wanted to mention. If someone does not qualify for Upsolve, check with your local college to see if they have a law program. Sometimes they do cases for the experience while going through school. Obviously the instructors are a huge part of it, but just know that is another option. I received a call yesterday from our University that they would help me file and answer any questions that I had. The only problem with that was I filed a month ago, but they still said to call if I needed help.
