Veronica, thanks so much for reaching out! This isn't something that Upsolve's software helps with directly- but you've come to a good place to ask questions and learn more!

It sounds like you're hoping to contest the overpayment and file an appeal. Is that right?

Generally speaking, yes! Unemployment overpayment is generally considered a dischargeable debt for the purposes of bankruptcy. You'll still want to consider whether, all considered, bankruptcy is the best option for you.

How long do you have to pay back an overpayment?

Yolanda, thanks for asking! There may be a few different options that are a good fit in the case of an overpayment. Depending on how long it's been, it may be possible to file an appeal or request a waiver of repayment.

Upsolve Community Member
If this isn't possible, your state department of labor would generally set the timeline. They might be open to negotiating a repayment plan, so you can call them to learn more.

Upsolve is a 501(c)(3) nonprofit that started in 2016. Our mission is to help low-income families who cannot afford lawyers file bankruptcy for free, using an online web app. Spun out of Harvard Law School, our team includes lawyers, engineers, and judges. We have world-class funders that include the U.S. government, former Google CEO Eric Schmidt, and leading foundations. It's one of the greatest civil rights injustices of our time that low-income families can’t access their basic rights when they can’t afford to pay for help. Combining direct services and advocacy, we’re fighting this injustice.
